Terms of Use

1. Agreement

By downloading, accessing or using Fitgram, you agree to these Terms of Use and to Apple's standard Licensed Application End User License Agreement where it applies. If you do not agree, do not use Fitgram.

2. What Fitgram does

Fitgram helps users log meals, estimate calories and macronutrients, track water, weight, activity, streaks, achievements, recipes, friends and personal goals. Fitgram may include AI-assisted features for photo recognition, voice parsing, manual food correction, product nutrition lookup and recipe suggestions.

Fitgram is provided for general wellness and nutrition tracking. It is not a medical device, does not provide medical diagnosis or treatment, and does not replace advice from a doctor, dietitian or other qualified professional.

3. Eligibility and account responsibility

You must be at least 13 years old to use Fitgram. You are responsible for the information you enter, for keeping your device secure, and for activity that happens through your account or device.

If account sign-in is available, you agree to provide accurate information and to use the account only for yourself unless a feature explicitly allows otherwise.

4. Free features and Pro features

Fitgram may offer a free tier with limits such as daily AI request limits, limited recipes, locked Pro blocks, limited Coach Ola access or other restrictions shown in the app. Fitgram Pro unlocks paid features shown on the paywall at the time of purchase, such as expanded AI usage, coaching, recipes, exports, goals, achievements or friend features.

We may adjust feature availability, limits and product packaging over time. Existing purchases will continue to be handled according to Apple's subscription rules and applicable law.

5. Fitgram Pro auto-renewable subscriptions

• Payment is charged to your Apple ID after you confirm purchase through Apple's purchase sheet.
• Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current subscription period.
• Your Apple ID may be charged for renewal within 24 hours before the end of the current period.
• You can manage, cancel or turn off auto-renewal in App Store → Apple ID → Subscriptions.
• If a 7-day free trial or other introductory offer is available, Apple shows the offer before confirmation.
• If you purchase during a trial, any unused portion of that trial may be forfeited where Apple rules allow.
• Prices, currencies, billing periods and taxes can vary by country and are displayed by Apple before purchase.

6. Refunds

Payments are processed by Apple. Refund requests are handled by Apple, not directly by Fitgram. You can request a refund through reportaproblem.apple.com or Apple Support.

7. AI, barcode and nutrition estimates

Fitgram may estimate food names, portions, calories, protein, carbohydrates and fat using AI, barcode databases, local food libraries, OCR or user input. These results can be incomplete, outdated or wrong. You should review and correct entries before saving or relying on them.

You agree not to use Fitgram as the only basis for medical, pregnancy, allergy, eating disorder, diabetes, athletic competition or other high-risk decisions. For health decisions, consult a qualified professional.

8. User content

You keep ownership of meals, photos, recipes, notes, profile details and other content you add to Fitgram. You grant Fitgram a limited license to store, process, display and transmit that content only as needed to provide the app, sync, AI, support and related features.

You must not upload content that is unlawful, abusive, misleading, infringing, harmful, malicious or that violates another person's rights.

9. Acceptable use

You agree not to misuse Fitgram, bypass limits or technical protections, attack or overload services, reverse engineer the app except where law allows, scrape or resell Fitgram data, abuse AI features, impersonate others, harass users, or use the app for unlawful purposes.

10. Friends and social features

If you use friends, leaderboards, reactions, QR invite or profile features, you understand that selected profile and progress information may be visible to connected friends. You are responsible for who you add and what you choose to share.

12. Third-party services

Fitgram may rely on Apple, AI providers, barcode databases, hosting providers, analytics or diagnostics providers and other services. Their services may have separate terms and availability. We are not responsible for third-party outages, database errors or platform restrictions.

13. Changes, suspension and availability

We may update Fitgram, change features, correct errors, suspend access, remove content or stop providing features when needed for security, legal compliance, platform requirements, abuse prevention or product improvement. We aim to avoid unnecessary disruption, but uninterrupted availability is not guaranteed.

14. Disclaimer of warranties

Fitgram is provided "as is" and "as available" to the maximum extent permitted by law. We do not guarantee that results are accurate, that the app will meet every personal goal, or that all features will be available at all times.

15. Limitation of liability

To the maximum extent permitted by law, Fitgram and its team are not liable for indirect, incidental, special, consequential or punitive damages, lost data, lost profits, health decisions made without professional advice, or losses caused by inaccurate AI, OCR, barcode, nutrition or third-party data.

16. Apple standard EULA

These terms are intended to work together with Apple's standard Licensed Application End User License Agreement. Where these terms do not address a topic, Apple's standard EULA applies: https://www.apple.com/legal/internet-services/itunes/dev/stdeula/.

17. Governing law

These terms are governed by applicable consumer protection laws and, where not overridden by mandatory local law, the laws applicable to the Fitgram team's place of operation. Nothing in these terms limits rights you cannot waive under local law.
